Terms & Conditions

Youth Tutoring Project Terms and Conditions: 

Effective Date: July 20, 2024

1. Acceptance of Terms

By accessing or using the services provided by the Youth Tutoring Project (“we,” “our,” or “us”), you (“user,” “you,” or “your”) agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree with these terms, please do not use our services.

2. Services Provided

The Youth Tutoring Project offers free one-on-one tutoring services to students in grades K-8. Our services include academic tutoring in various subjects, homework help, and educational resources. These services are provided at no cost to the users.

3. Eligibility

Our services are available to students in grades K-8 who have registered with us. By registering, you represent and warrant that you are either the parent or legal guardian of the student or have obtained permission from the student’s parent or legal guardian.

4. Registration and Account Security

To access our tutoring services, you must register an account. When you register, you agree to:

  • Provide accurate, current, and complete information during the registration process.

  • Maintain the security of your password and identification.

  • Notify us immediately of any unauthorized use of your account or any other breach of security.

  • Accept all responsibility for any activities that occur under your account.

5. Use of Services

You agree to use our services for lawful purposes only and in a manner that does not infringe the rights of or restrict or inhibit the use and enjoyment of our services by any third party. Prohibited activities include, but are not limited to:

  • Engaging in any conduct that is unlawful, harmful, or fraudulent.

  • Using our services to transmit, distribute, or store material that violates any applicable law or regulation.

  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

6. Tutor and Student Conduct

Tutors and students are expected to adhere to the following code of conduct:

  • Treat each other with respect and courtesy.

  • Be punctual and prepared for each tutoring session.

  • Communicate openly and honestly.

  • Use appropriate language and behavior during sessions.

  • Report any concerns or issues to the Youth Tutoring Project immediately.

7. Content and Intellectual Property

All materials provided through our services, including but not limited to text, graphics, logos, and software, are the property of the Youth Tutoring Project or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of our services without our express written permission.

8. Privacy

We value your privacy and are committed to protecting your personal information. Please review our Privacy Policy for details on how we collect, use, and safeguard your information.

9. Limitation of Liability

To the fullest extent permitted by law, the Youth Tutoring Project, its affiliates, directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use our services.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

  • Any interruption or cessation of transmission to or from our services.

  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.

  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Youth Tutoring Project, its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • Your use of and access to our services.

  • Your violation of any term of these Terms and Conditions.

  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

  • Any claim that your use of our services caused damage to a third party.

11. Modifications to Services and Terms

The Youth Tutoring Project reserves the right to modify or discontinue, temporarily or permanently, our services (or any part thereof) with or without notice at any time. We may also revise these Terms and Conditions from time to time by updating this posting. By continuing to use our services after such changes are posted, you agree to be bound by the revised terms.

12. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use our services will immediately cease.

13. Governing Law

These Terms and Conditions shall be governed and construed in accordance with the laws of [Your State/Province], without regard to its conflict of law provisions. Any dispute arising out of or related to these terms shall be brought in the courts located in the province of Ontario, British Columbia, the state of New York, and the country of India and the United Arab Emirates, and you consent to the jurisdiction of such courts.

14. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and the Youth Tutoring Project concerning our services. If any provision of these Terms and Conditions is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
